NOW AROD COULD TESTIFY


Alex Rodriguez's arbitration hearings have been at recess for some time. They are set to resume on November 18th. Now it seems that ARod is willing to testify.

ARod must first submit to a pre-interview with the MLB, under a provision in the collective bargaining agreement. If for any reason they feel he is lying about anything during the pre-interview, it can result in further sanctions. It will then be determined whether or not ARod will be allowed to testify. However, as Wallace Matthews of ESPN points out, the issue is not with the pre-interview.


The problem really arises if his testimony conflicts with what he told the grand jury in 2010. The testimony he made during the investigation of Anthony Galea, who admitted to smuggling human growth hormones into the United States, is sealed. As put by Matthews (HERE) "The testimony is still under seal, and while MLB filed a motion in October to have A-Rod's testimony unsealed, there has been no indication it will ever be made public. But if, for example, Rodriguez testifies before Horowitz that he never used HGH, it could open the door for baseball to renew its efforts to make his grand jury testimony public on grounds that MLB suspects he answered the question differently three years ago."

Everyone has the right to proclaim their innocence. That is not in question. And I would hope that ARod wouldn't say anything that could possibly get him in more trouble. But if for any reason, they suspect his testimony conflicts what he said to the grand jury three years ago, he may run into a problem.
