Anyway, we have real quick update here. It seems that Alex Rodriguez has gone ahead and filed his injunction. According to ABC News "As part of the lawsuit filed Monday in federal court in Manhattan, Rodriguez made public the decision by arbitrator Fredric Horowitz." In short, all information that led up to Horowitz decision will be made public. ESPN reported that:
"During a short hearing in federal court in Manhattan U.S. District Judge William H. Pauley II brushed aside concerns from Major League Baseball Players Association that revealing portions of the intended suit and Saturdays decision by arbitrator Fredric Horowitz might violate confidentiality provisions of the sport's collective bargaining agreement."
In the same piece, Pauley is quoted as saying:
"Given the intense public interest in this matter and Commissioner Selig's disclosures last night on '60 Minutes,' it's difficult to imagine that any portion of this proceeding should be under seal. Mr. Rodriguez is directed to file his unredacted complaint with the attached exhibits."
It is believed that the players union will edit any part of the arbitration ruling that should remain confidential under he collective bargaining agreement, in order to publish it. The lawsuit is against the MLB, and the players union in an effort to overturn the suspension. ARod's team is saying that the Players Association breeched it's duty to represent him. I tend to agree. They were quiet through the entire ordeal. But it is clear by the Joint Drug Agreement that the punishment did not fit the crime.
I have made it no secret that I believe the suspension was unfair. ARod is a first time offender, without a failed drug test, facing 211-game suspension? It was all orchestrated by Bud Selig in order for him to retire with his hero cape on. I won't sing praises of ARod's innocence. My mantra has been fair punishment. Emphasis on "fair." This case is a long shot, though.
